Terms & Conditions for TheMahjong.io

Welcome to TheMahjong.io (“Site” or “Service”), owned and operated by Forty Media OOD (UIC/EIK: 208189754), Sofia, Bulgaria (“Forty Media,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Site.

These Terms work together with our Privacy Policy (which explains how we collect and use personal data). Some regions grant additional consumer rights; we apply these where required by law (e.g., EU, California).

1) Who May Use the Service (Eligibility)

  • You must be at least 13 years old to use the Site.
  • If you are located in the EU/EEA, you must be 16+ to create an account or otherwise provide personal data, unless parental consent is provided under applicable law.
  • If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2) Accounts & Security

Some features may require an account.

  • Accurate Information. You must provide accurate, up‑to‑date information.
  • Credentials. Keep your login credentials confidential. You are responsible for all activities under your account.
  • Notice of Breach. Tell us promptly at solitairex@fortymedia.io if you suspect unauthorized use.
  • Our Rights. We may suspend or terminate accounts that violate these Terms or applicable law.

3) Non‑Commercial License to Use

We grant you a personal, limited, revocable, non‑exclusive, non‑transferable license to access and use the Site for personal, non‑commercial entertainment only. You agree not to:

  • copy, modify, distribute, sell, or lease any part of the Site or its content;
  • reverse engineer, decompile, or attempt to extract source code except as permitted by law;
  • circumvent or interfere with security or access controls;
  • scrape, crawl, or use bots/automation to play the game or collect data.

4) Gameplay, Scores, and Virtual Features

  • The Site may offer scores, achievements, leaderboards, themes, or other virtual, non‑monetary features. These have no cash value and are not transferable.
  • No Gambling. The Site does not offer real‑money gambling or wagering.
  • We may add, modify, or remove game features at any time.

5) Purchases, Subscriptions & Refunds (If Offered)

If we offer optional paid features (e.g., ad‑free play, cosmetic themes):

  • Pricing & Taxes. Displayed prices may exclude taxes or fees depending on your location.
  • Billing. By submitting a payment method, you authorize charges for the selected items or subscription cycle.
  • Renewals. Subscriptions (if any) renew automatically unless canceled before the renewal date.
  • Refunds. Unless required by law, all purchases are final.
    • EU Right of Withdrawal: For digital content supplied immediately, you may be asked to expressly consent to immediate delivery and acknowledge you lose the 14‑day withdrawal right once delivery begins. Where the right applies and has not been waived, you may contact us for assistance.
  • Platform/Store Policies. If purchased through a third‑party store (e.g., app store), that store’s terms and refund policies apply.

6) Acceptable Use & Community Standards

You agree not to use the Site to:

  • break the law or infringe rights of others (including IP, privacy, or publicity rights);
  • upload or share content that is unlawful, harmful, harassing, hateful, or otherwise objectionable;
  • deploy cheats, automation, exploits, or unauthorized third‑party tools;
  • introduce malware, disrupt servers, or overload infrastructure;
  • collect information about others without consent.

We may remove content, restrict features, or terminate access to protect users and the Service.

7) User Content & Feedback

If the Site allows usernames, avatars, or other submissions (“User Content”):

  • License You Grant Us. You grant Forty Media a worldwide, non‑exclusive, royalty‑free license to host, display, and otherwise use your User Content solely to operate and improve the Service.
  • Your Responsibilities. You must have the rights to the content you submit; do not submit prohibited or infringing content.
  • Feedback. If you send suggestions or feedback, you grant us a perpetual, irrevocable license to use them without obligation to you.

8) Intellectual Property

All rights in the Site and its content (including software, code, design, tile sets, graphics, text, logos, and trademarks) belong to Forty Media or its licensors, and are protected by applicable laws.
No rights are granted except as expressly stated in these Terms.

We may integrate or link to third‑party services (e.g., analytics, ads, social features, payment processors). Those services are governed by their own terms and privacy policies. We are not responsible for third‑party content or practices.

10) Health & Accessibility Notice

The Site is for entertainment and general well‑being support only; it does not provide medical advice. If you have health concerns (e.g., vision, cognition, or motor issues), consult a qualified professional before prolonged gameplay.
We aim to make the Site accessible to users of different ages and abilities and welcome feedback at solitairex@fortymedia.io.

11) Privacy

Your use of the Site is also governed by our Privacy Policy. Please review it to understand how we collect, use, and share information and your rights under GDPR (EU) and CCPA/CPRA (California).

12) Disclaimers

  • The Site is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including fitness for a particular purpose, non‑infringement, and availability.
  • We do not warrant that the Site will be uninterrupted, secure, or error‑free, or that defects will be corrected.
  • Some jurisdictions do not allow certain disclaimers; in such cases, the above may not apply to you to the extent prohibited by law.

13) Limitation of Liability

To the maximum extent permitted by law, Forty Media and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, business interruption, or goodwill arising from or related to your use of the Site, even if advised of the possibility of such damages.
Our aggregate liability for direct damages will not exceed the greater of (a) amounts you paid to us in the 12 months preceding the claim or (b) USD $50.
Consumer rights in some jurisdictions may grant additional protections; we do not exclude liability where prohibited (e.g., for death or personal injury caused by negligence, fraud, or willful misconduct).

14) Indemnification

You agree to indemnify and hold harmless Forty Media from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third‑party rights.

15) Suspension, Termination & Changes to the Service

We may modify, suspend, or discontinue all or part of the Site at any time.
We may terminate or suspend your access if you violate these Terms or if required by law. Upon termination, the license granted to you ends immediately.

16) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest revision. Material changes will be effective upon posting (or as otherwise stated). Continued use of the Site after changes constitutes acceptance of the updated Terms.

17) Governing Law; Venue; Consumers

  • Governing Law & Venue. These Terms are governed by the laws of Bulgaria, without regard to its conflict of laws rules. Courts in Sofia, Bulgaria will have exclusive jurisdiction, except where consumer protection laws require otherwise.
  • EU Consumers. If you are an EU consumer, you may have access to alternative dispute resolution in your country and protections under EU consumer law that cannot be waived.
  • US Consumers. Some state laws provide specific consumer rights that may supersede parts of these Terms.

18) Digital Millennium Copyright Act (DMCA) / IP Notices (US)

If you believe content on the Site infringes your rights, please email solitairex@fortymedia.io with:

  • your contact information;
  • a description of the copyrighted work or other right you claim is infringed;
  • the URL/location of the allegedly infringing material;
  • a statement of good‑faith belief that the use is not authorized;
  • a statement under penalty of perjury that your notice is accurate and that you are the rightsholder or authorized to act;
  • your physical or electronic signature.

19) Miscellaneous

  • Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver. Failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them as part of a merger, acquisition, or asset sale.
  • Language. We provide these Terms in English; translations (if any) are for convenience only.
